What is Traffic Criminal Law?
Most of the crimes committed in traffic occur in the form of negligent crimes. Crimes committed by negligence in traffic, on the other hand, have an important place among negligent crimes regulated in the Turkish Penal Code. It is especially necessary for practitioners to evaluate the traffic crimes frequently encountered in practice, taking into account their own characteristics.

What is the Subject of Traffic Criminal Law?

The crimes committed in traffic have been examined in terms of traffic criminal law. In addition, misdemeanors committed in traffic within the traffic criminal law have also been examined. The person concerned has the right to object to the traffic fine. Before objecting to the traffic ticket, the relevant person should confirm whether the fine has been issued or not. The best way to understand that the penalty has not been cut is the presence of the notification. If the traffic fine issued by the authorized persons is not notified within ten working days, the other party has the opportunity to appeal. Apart from this, citizens can see the fines issued via e-government. You can also learn from the General Directorate of Security website, the Revenue Administration website and the PTT website.

Can Traffic Fines Be Appealed?

If the traffic fine is issued in absentia, that is, on the license plate, the objection period will start from the notification of the fine to the person concerned. In cases where the police officer cuts the fine against the person concerned, the traffic fine objection period will start to run on the same day.

Can Traffic Fines Be Appealed?

Objection to traffic fines is regulated by law. According to the Misdemeanors Law, a person sentenced to a traffic fine has the right to appeal within fifteen days for the fine issued to him. If the person does not object within this period, the fine will be finalized.

In order to object to a traffic ticket, certain documents must be prepared and submitted to the court. One of these documents is the petition of appeal. The objection period will start to run when the petition is submitted to the Traffic Courts, provided that the fifteen-day period determined in accordance with the Misdemeanors Law is not missed, and to the Criminal Judgeship of Peace in places where these courts are not available.

Attached to the petition are a photocopy of the report sent to the person concerned, a photocopy of the person’s identity card, a photocopy of the license and driver’s license. The petition should explain why the traffic ticket should be cancelled. These explanations can be supported by the precedent decisions of the higher courts in the past years.

Under normal circumstances, the appeal authority is the Criminal Judgeship of Peace, but if there is a decision to ban the vehicle from traffic with this penalty, the appeal authority for the second criminal sanction is the administrative court in the place where the law enforcement unit is located. The objection period here is 60 days from the notification of the decision.
