What is Real Estate Law?

Real estate law is a sub-branch of property law. Provides resolution of disputes related to property law in the Republic of Turkey. Real estate is a subject that includes lands, apartments, buildings, residences or all other immovables. Within the scope of this legal discipline, all real estate issues are also handled.

In Which Courts Are Real Estate Law Cases Heared?

Real estate law cases are mostly heard in civil courts of first instance. Because the lawsuit is filed in the nearest court where the real estate is located. However, since the place and location criteria are effective, the functioning of the court takes shape accordingly.

  • Buying and selling real estate and leasing,
  • Inspection of construction and zoning projects for compliance with the legislation;
  • Preparation of all types of lease agreements,
  • Obtaining permits and preparing necessary licenses, executing title deed and zoning cases,
  • Issues such as the acquisition of property by foreigners and the establishment of the same rights are carried out.

What is Property Rights?
The right of ownership provides full authority over immovable property. To the owner of the property right; gives the right to use, benefit and save. The proprietor may sell, lease, enjoy the fruits of the immovable property, and establish limited real rights in favor of another person. If he is a limited real right owner, he can only use the powers provided by this real right.
