What is Enforcement Law?

Enforcement law is the branch of law that deals with the debt of the debtor who cannot pay his debt, upon the request of the creditor, by confiscating his movable and immovable assets by the force of the state. The entire process is run and supervised by the court.

What is Enforcement Proceedings Without Writ?
In the execution proceeding without judgment, debts based on a promissory note or a similar document are taken as the subject. The lawsuit initiated for document-based debts is called execution proceeding without judgment.

    There are too many queues in enforcement cases and the case can be postponed until a few months after the application is made. For this reason, the creditor who wants to file a lawsuit should act quickly.
  • In order to initiate enforcement proceedings, an application must be made to the enforcement office.
  • Generally, enforcement proceedings are clarified within 1 month after the enforcement application and the proceedings are initiated.
  • In lawsuits, the debtor also has the right to object, and therefore the litigation process may take longer.
  • If the debtor still does not pay despite the threat of execution, in this case, foreclosure proceedings will be initiated by the court.

Due to the strict formal structure of the Enforcement and Bankruptcy law, every step from how the enforcement proceedings are started to how it is finished has been planned step by step by the legislator. In this context, incomplete and erroneous transactions made outside the rules set by the legislator may even cause the cancellation of the enforcement proceedings.

In the researches conducted in our country, 8% of the execution files of the debts are collected illegally. This information means that if a person who knows the enforcement proceedings well carries out this process, the unpaid money is paid to the receivables.
